Is Karnataka heading for President's rule?

The speaker of the Karnataka Legislative Assembly has issued a communication here stating that only 8 Janata Dal S MLA’s and 26 Congress MLA’s had signed on the register at the assembly today. The speaker was trying to indicate that just 34 of the opposition mlas were serious enough to attend the proceedings while the rest who did not sign had no intention of coming to the assembly in the first place.

The Bharatiya Janata party in Karnataka has decided to parade all its MLA’s before the President of India on Tuesday. Taking this decision at a just concluded meeting the party leaders sought to put to rest accusations that they fell short of a majority and resorted to arm twisting to win the trust vote on Monday. The BJP will be flying into Delhi either tonight or early tomorrow and would parade all their MLA’s before the president of India. Further the party has also decided to intensify their protest against governor h r Bharadwaj who sent a letter to the union government seeking dissolution of the house. The party said it will resist all attempts by the union government to dissolve the assembly.
The union cabinet will meet tomorrow and take a decision on this matter.

The police department is contemplating action against congress leader siddaramaiah after the latter is alleged to have abused the commissioner of police Shankar bidri in the assembly today. Bidri told reporters in Bangalore that to unparliamentarily language was used against him by the leader. He said he was looking at the case closely and action was being contemplated. A huge show down occurred between bidri and siddaramaia at the assembly with the leader alleging that the top cop prevented him from entering the house ahead of the trust vote today.

The Speaker of the Karnataka legislative assembly has disqualified 16 MLAs just ahead of the crucial trust vote against the BJP government today. Speaker, K G Bopaiah who had heard the disqualification plea on Sunday passed the order of disqualification at 2.30 am on Monday.
This means that the 16 rebel MLAs who had been plotting the fall of the government cannot vote in the trust motion today. With the disqualification the strength of the Karnataka assembly has come down to 208 which means the BJP will have to get at least 105 votes to get through the trust vote. The bJp currently has 100 members following this disqualificafion.They will rely on the votes of the speaker, nominated member and the 4 independents which the party has claimed they have the support of.
The rebels who have been barred from voting have de died to approach the chief justice of the Karnataka high court directly. They feel that the order is unjust and also will challenge it before the high court today. They would seek an early hearing since the trust vote commences at 10 am and proceedings in the court normally start only by 10.30 am.

The Karnataka high court has adjourned to tomorrow hearing on the plea changing the order of the speaker had disqualified 16 MLA’s- 11 BJP and 5 independents. The bench comprising chief justice g s Kehar and justice n kumar will commence proceedings tomorrow in which Soli Sorabhjee will argue in favor of the government.
The arguments for the rebels have concluded wit their counsel telling the court that the order of the speaker is bad in law.

The union cabinet has decided to act on the governor’s recommendation tomorrow. Congress leaders who are closely monitoring the situation in Karnataka told rediff.com that a decision on whether to recommend presidents rule keep the house under suspended animation or not consider the governors recommendation will be taken tomorrow.
Governor of Karnataka H R Bhardawaj had recommended presidents rule following the commotion in the Karnataka assembly in which the bjp won the trust vote.

The BS Yeddyurappa government is a corrupt one and he is acting like a despot said P P Rao senior counsel arguing for the rebels before the Karnataka high court. The division bench of the high court is hearing a petition challenging the decision of the speaker which disqualified 16 mlas ahead of the trust vote.
RO submitted to the court that his clients the 11 BJP mlas had not resigned from the party but had just quit the Yeddyurappa government. This cannot amount to disqualification as my clients have not indged in anti party activities. He also cites the various incidents that have shaken this government in the past two years. He argued that even the lokayukta had resigned after alleging corruption charges against the go ernmenf.
Next on the line is Soli S Sorabhjee who will commence arguments for the state government in a while.

The recommendation of the governor suggesting Presidents rule needs to be thrown into the dust bin senior BJP leaders told Rediff.com. Dr V S Acharya senior cabinet minister said that the BJP just held a meeting and they have no worry about this recommendation. Throw it into the dust bin that's where it deserves to be he said. The S R Bombai judgment clearly states that the governor has no role here. More over we have the numbers and the speaker has conducted the proceedings and that is for every one to see. We are confident that the central government will think 10 times before it even acts on the matter. If better sense prevails it will not consider the recommendation.

President of the BJP K S Eshwarappa has come down heavily on governor H R Bharadwaj terming him as a proxy opposition leader. Addressing media persons in Bangalore he said that the party will hold talks with the high command and chalk out a plan on how to oust the governor. He has put the opposition out of work in Karnataka as he has taken on their responsibility he also added.
Meanwhile the BJP leaders took out a procession in Bangalore celebrating their victory. The party leaders have now left for the garden palms resort where they will take stock of the happenings since one week and discuss on how to reshuffle the cabinet.

The BJP will go for immediate corrective measures and we have disowned the rebels from our party, Dr V S Acharya, senior cabinet minister from Karnataka told Rediff.com. We have to have a cabinet reshuffle immediately since 7 of our ministers turned rebels. We are not making any attempts to get the rebels back. Today they are ex-MLA’s and they can't contest the elections for another six years. We have followed the correct procedure and won the trust vote and the opposition is crying foul only because they were defeated.
On the presence of MLCs in the house Acharya said they had not voted during the motion. As ministers they have every right to be in the house. Ulitmately they do not have the right to vote, Acharya also said.

The opposition I'm Karnataka continued to cry foul over the just concluded trust vote. Apart from alleging foul play by the BJP which prevented opposition leaders from entering the house today, they are now alleging that legislative council members of the bjp too were present in the house.
The opposition alleges that members of the legislative council who have no business in the assembly had somehow managed to get in. The opposition alleges that MLCs Janardhan Reddy; V so manna and vijayshankar were also present KN the house which they allege helped the bjp win the voice vote today.
The opposition claims that they had the support of 120 mlas in the house but many were prevented from getting into the house and the voice vote was conducted in a hurry. They say they have demanded imposition of president’s rule in Karnataka.

The Janata Dal (s) which just completed its meeting with Governor H R Bharadwaj is hopeful that some action against the BJO government will be taken. H D Kumaraswamy who addressed the media outside Raj Bhavan said he has been assured that the governor will act by evening.
He also criticized the BJP and said that today it has been proven that this is nothing but a goonda government.

The Karnataka crisis has shifted to the Karnataka high court and a special division bench will hear arguments on the matter at 3 PM additional advocate general, K M Natraj told rediff.com,
the legal team of the rebel MLA’s moved the bench and the bench instructed them to come back at 3 pm when it would hear the matter.
Both the state government and the petitioners would put forth the case before the bench which hears the plea regarding the disqualification of the 16 mlas ahead of the crucial trust vote.

The speaker of the Karnataka legislative assembly who has been under fire for disqualifying the rebel MLA’s and also the 5 independents has come out in his own defense and said that no rule or procedure has been violated. Speaking to the media in Bangalore, speaker K G Bopaiah said that when required I will give the numbers to the government. I have the numbers with me and I know exactly who have voted for and against the motion. I have followed every rule in the book and I have not exceeded my jurisdiction while deciding the matter, Bopaiah also informed when contacted.

An emotional B S Yeddyurappa thanked god and cursed the opposition just after winning the trust vote through a voice vote. Addressing media persons I'm the vidhan Soudha's just a while ago, the chief minister of Karnataka said that the opposition is frustrated that it didn't have the numbers to pull down the government. The bjp has proved its majority and it will, complete its term.
Equating H D Kumaraswamy the chief engineer behind this crisis to Duryodhana, the chief niter said all his attempts had failed. I have no idea what prompted hi, to do this. I know fully well who has paid whom money in this entire drama. The bjp will focus on governance and I apologize to the people for all this drama. A cabinet reshuffle is on the cards he added. He also apologized to the media for the manner in which they were treated and said an inquiry into the man handling of media persons will be conducted and the guilty police punished.

Governor of Karnataka H R Bharadwaj will examine the trust vote which was won by B S Yeddyurappa government by a voice vote. The governor who had sent his observers to witness the proceedings will seek a report from them and also examine the CCTV footage of the trust vote.
Meanwhile all opposition leaders have gone to Raj Bhavan seeking the intervention of the governor into the matter. The opposition has cried foul over the manner in which the proceedings were held. They alleged that they had not been given an opportunity and the voice vote was held not in conformity witness the rules. They may also seek an explanation from the speaker and ask him for a division of the votes.

It was all over in a matter of five minutes with the Bharatiya Janata Party winning the crucial trust vote in the floor of the Karnataka legislative assembly. The speaker K G Bopaiah announced that the decision will made through a voice vote.
The house has now been adjourned following which the speaker will have to explain the division of the votes. The congress mlas meanwhile headed to the Raj Bhavan to lodge a complaint against the government for the manner in which proceedings were conducted. The BJP managed to win the trust vote after the speaker disqualified 16 MLA’s and the house number was reduced to 208.

Proceedings which were to commence at 10 am have not been able to start off as yet with terrible scenes being witnessed at the Karnataka legislative assembly. mlas opposing the BJP came to blows with security personnel and even injured one of the marshals who were teeing to restrict their entry in the wake of the order of the speaker. The rebel mlas who defied this order headed straight to the chair of the speaker stood on top of it and staged a protest. The congress and the JDS MLA’s squatted on the well of the house and refused to permit the proceedings to be commenced. Security has been increased three fold around the Vidhan Soudha area which houses the legislative assembly.



BJP Startergy to overcome the floor test hurdle

Chief Minister of Karnataka B S Yeddyurappa who faces an acid test today has just entered the Karnataka legislative assembly amidst tight security. Following him was speaker of the assembly K G Bopaiah whose order disqualifying 16 mlas has come under fire from the opposition.
Meanwhile there were unprecedented scenes at the Vidhan Soudha witness the 16 MLA’s gaining entry into the house where the proceedings will be conducted. The MLA’s managed to gain entry despite the speaker barring them entry into the house. All the 16 MLA’s who are presently seated in the house entered the house after breaking glasses in the assembly with the help of JDS MLA’s. The rebels claim that the order is against law and none can prevent them from entering the house.

Defying the order of the speaker the 16 disqualified MLA’s have entered into the Vidhan Soudha with the help of the JD(s) mlas and are staging a protest. The 16 MLA’s who were refused an appointment by the chief justice of Karnataka at his residence joined the jds mlas and have entered into the Vidhan Soudha.
As per the order of the speaker the MLA’s will not be permitted to take part in the proceedings which is to commence at 10 am. The Vidhan Soudha which houses the Karnataka legislative assembly is currently a hotbed of political activity. All the MLA’s from all parties have just arrived at the house and the chief minister B S Yeddyurappa is expected to reach in the next ten minutes.
Meanwhile the registrar before whom the petition against the speakers order has been filed will place the matter before the chief justice seeking allotment of a bench.

In an interesting development all the 16 MLA’s who have been disqualified by the speaker of the assembly have landed up at the residence of the Chief Justice. While their legal team has already filed the petition before the registrar of the high cour the rebels have decided to request the chief justice to intervene in the matter.
They will request chief justice G S Kehar to grant them relief and take the matter up out of turn. They would also seek a stay on the order against them and delay in the proceedings at the assembly so that their petition does not become infructuous.

The congress MLA’s numbering 73 were the first to reach the Karnataka Legislative assembly, an hour before the trust vote against the BJP government could commence. All the congress MLA’s who were put up in a resort near Bangalore landed at the assembly and warned that they will not let the speaker conduct the house in the wake of his order which disqualified 16 MLAs. The MLA’s questioned as to how the speaker had the right to disqualify the independent MLA’s and compared the Yeddyurapparegime to that of Hitler. The congress has decided to wait for order of the jig court and then approach the governor.
The BJP legislators who were holed up in a resort also left for the assembly. All the legislators conducted prayers at a temple before leaving for the assembly.

The opposition parties are up in arms against the order of the speaker in which 16 MLAs were disqualified. Senior congress leader Siddaramaiah told reporters in Bangalore that the speaker has exceeded his jurisdiction while passing this order. He also said that the governor will be apprised of this matter and also added that Raj Bhavan was watching every development closely.
Meanwhile the disqualified MLAs are making every effort to seek a stay on the order of the speaker. The legal team comprising nearly 40 persons made a beeline to the high court filing section and is seeking early posting of the matter. They have also advised the political leaders opposing the order of the speaker to approach the governor seeking his interference in the matter. The rebels who are not revealing the cards say that they have something else planned in case they are not allowed inside the house today.

Commissioner of police, Bangalore city, Shankar Bidri told media persons tat 900 persons had been taken into preventive custody. In addition to this the prohibitory orders have been clamped around the Vidhan Soudha which houses the Karnataka the legislative assembly. In addition to this media persons too have been barred from entering into the assembly.
The commissioner of police has also ordered the closure of all bars in the city for the entire day.
